Frank Bretschneider
2. Warteliste & E-Mail-Anmeldung
Daten: E-Mail-Adresse (Pflicht), meistgenutzte App (optional), Sprache und Herkunft der Anmeldung sowie die IP-Adresse des Zugriffs.
Zweck: Benachrichtigung zum Beta-Start und Frühzugang.
Rechtsgrundlage: Einwilligung — Art. 6 Abs. 1 lit. a DSGVO.
Cookies & lokale Speicherung: Die Website setzt keine Cookies.
4. Datenübermittlung in Drittländer
Rechtsgrundlage: Vertragserfüllung — Art. 6 Abs. 1 lit. b DSGVO.
Rechtsgrundlage: Vertragserfüllung — Art. 6 Abs. 1 lit. b DSGVO.
Rechtsgrundlage: Vertragserfüllung — Art. 6 Abs. 1 lit. b DSGVO.
Rechtsgrundlage: Vertragserfüllung — Art. 6 Abs. 1 lit. b DSGVO.
Rechtsgrundlage: Vertragserfüllung — Art. 6 Abs. 1 lit. b DSGVO.
Rechtsgrundlage: Nachweispflicht für Einwilligungen — Art. 6 Abs. 1 lit. c i. V. m. Art. 7 Abs. 1 DSGVO.
6. Empfänger
| Empfänger | Rolle | Wofür |
|---|---|---|
| Hetzner Online GmbH, Deutschland | Auftragsverarbeiter | Betrieb von Website, Server und Datenbank (3, 5) |
| Mistral AI SAS, Frankreich | Auftragsverarbeiter | Termin-Erkennung (5.4) |
| Berichtigung | Art. 16 DSGVO | Korrektur unrichtiger Daten |
| Löschung | Art. 17 DSGVO | Löschung deiner Daten — dein Konto löschst du jederzeit selbst in der App (5.9) |
| Einschränkung | Art. 18 DSGVO | Einschränkung der Verarbeitung |
| Übertragbarkeit | Art. 20 DSGVO | Daten in maschinenlesbarem Format erhalten |
| Widerspruch | Art. 21 DSGVO | Gegen Verarbeitung auf Basis berechtigter Interessen, z. B. die Auswertung in 5.5 |
| Widerruf | Art. 7 Abs. 3 DSGVO | Einwilligung jederzeit mit Wirkung für die Zukunft widerrufen |
8. Keine automatisierte Entscheidung
PRIVACY
Privacy Policy
Applies to memiq.freestyling.de and the MemIQ app
Version 2.0 · in force from 1 October 2026
This is a translation for your convenience. The German version is legally binding.
1. Controller
The controller within the meaning of the GDPR is:
Frank Bretschneider
Herderstraße 10, 50931 Köln, Germany
Email: abuse@freestyling.de
No data protection officer has been appointed (the thresholds of Art. 37 GDPR and § 38 BDSG are not reached). The controller answers data protection requests directly.
2. Waitlist & email sign-up
Data: Email address (required), most-used app (optional), language and origin of the sign-up, and the IP address of the request.
Purpose: Notification about the beta launch and early access.
Legal basis: Consent — Art. 6(1)(a) GDPR.
Retention & withdrawal: Until you withdraw your consent, or at most 12 months after the official product launch. We delete the IP address after 30 days; it only serves to prevent misuse. You can withdraw at any time by email to the controller — without affecting the processing before.
3. Website: hosting & cookies
Hosting: The website and the app server run on a server of Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, in a data centre in Germany. Hetzner is our processor under Art. 28 GDPR.
Server logs: Visiting the website creates technical connection data (IP address, browser, requested address, time). It serves troubleshooting and defence against attacks and is deleted after 6 months. Legal basis: legitimate interest in secure, stable operation — Art. 6(1)(f) GDPR.
Analytics: We use no analytics or tracking tools.
Cookies & local storage: The website sets no cookies. The browser's localStorage holds only your language preference (mo_lang) — locally, without transfer to us.
4. Transfers to third countries
The MemIQ app processes your data in data centres in the European Union. Exceptions:
| Recipient | Country | Basis |
|---|---|---|
| Threema GmbH (only if you connect Threema) | Switzerland | Adequacy decision of the EU Commission |
| Google, Microsoft, Apple, Telegram, Signal (only if you connect them) | depending on the provider, also USA | You use these services yourself; MemIQ accesses your account there on your behalf. The provider's privacy policy applies to the processing there. |
Appointment detection (section 5.4) takes place in the EU. Should we switch to an AI provider outside the EU, we will update this policy beforehand and ask you to confirm it again.
5. Using the MemIQ app
This section describes what is processed as soon as you use a MemIQ account. The app server is hosted by Hetzner Online GmbH in Germany (section 3).
5.1 Account and sign-in
Data: User identifier, email address, password (only as a bcrypt hash, never in plain text), beta status, how you heard about MemIQ (invitation code or source, if any), time of account creation, and session keys of signed-in devices (stored only as a hash).
Purpose: Running your account, signing you in, and being able to sign out devices.
Legal basis: Performance of the contract — Art. 6(1)(b) GDPR.
Retention: Until your account is deleted. A signed-out device loses its session key immediately.
We use the origin information only internally, to understand how people find MemIQ. It is not passed on.
5.2 Messages and released sources
Data: Contents of messages from the chats and mailboxes you have released one by one (Telegram, Signal, Threema, Gmail, Outlook), including the images in them — and whatever you enter or photograph yourself in the Capture tab.
Purpose: Recognising appointments and reminders in them and suggesting them to you for confirmation.
Legal basis: Performance of the contract — Art. 6(1)(b) GDPR. Releasing an individual source is also your consent — Art. 6(1)(a) GDPR.
Retention: Message texts and images are processed only for the duration of the detection and are not stored; the only exception is in section 5.4. Without your release a source is not read — the default is "off".
How MemIQ is connected:
- Telegram: After you confirm with a code, MemIQ signs in to your Telegram account as an additional device. Technically this device sees all your chats; MemIQ only reads the ones you have released. For the selection list, the names and profile pictures of your chats are fetched and displayed, but the pictures themselves are not stored. You end the session in the app or in Telegram under Settings → Devices.
- Signal: MemIQ is set up as a linked device of your Signal account. Disconnect: in the app or in Signal under Linked devices.
- Threema: You send messages to MemIQ's Threema ID or add it to a group. Delivery runs through the Threema Gateway of Threema GmbH (Switzerland), end-to-end encrypted up to our server.
- Gmail and Outlook: OAuth access to the mailboxes you connect; only new emails from the time of release are read.
Other people in your chats: Others write in a released group too. Their messages are processed to the same extent; of these, only what goes into a recognised appointment is stored permanently.
5.3 Connected accounts
Data: Access credentials of the accounts you connect — OAuth tokens for Google and Microsoft, an app-specific password for iCloud, session data for Telegram and Signal —, the account name or address to tell several accounts apart, the connection status and the list of your calendars. In addition, the existing appointments of your connected calendars (Google, Outlook, iCloud) in the period of a suggestion — title, time, number of attendees and whether you are the organiser — to warn you about overlaps. They are retrieved and displayed for this purpose but not stored; the only exception is in section 5.5.
Purpose: Reading released sources, checking for overlaps before entering, and writing confirmed appointments to the calendar you chose.
Legal basis: Performance of the contract — Art. 6(1)(b) GDPR. You grant the access itself at the respective provider.
Retention: Until you disconnect the account. Credentials are stored AES-256-encrypted on the server, never on your device, and deleted immediately on disconnect.
Revoking access at the provider too:
- Google: myaccount.google.com/connections
- Microsoft: account.live.com/consent/Manage or myapps.microsoft.com for work or school accounts
- Apple: account.apple.com → Sign-In and Security → App-Specific Passwords
- Telegram: Settings → Devices
Google data ("Limited Use"): MemIQ's use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements. MemIQ uses Google data only to suggest appointments to you and to enter confirmed appointments and tasks — not for advertising, not to train general AI models, and humans read it only with your explicit consent, for security purposes or where the law requires it.
5.4 AI detection and message text
Data: The text of a message and the images in it, together with the appointments recently recognised in it as context.
Purpose: Recognising whether a message contains an appointment, and which one.
Legal basis: Performance of the contract — Art. 6(1)(b) GDPR. Storing the text for a limited time for troubleshooting takes place only with your consent — Art. 6(1)(a) GDPR.
Retention: By default, no message text is stored. If you agree in the app's settings, it is kept for up to 90 days and then deleted automatically. A withdrawal takes effect for the future: nothing new is created, and what has already been stored runs out its period.
Detection is performed by an AI provider on our behalf (currently Mistral AI SAS, France) — a processor under Art. 28 GDPR, not a third party. It may not use the data for its own purposes or to train its models.
5.5 Recognised appointments
Data: Appointment metadata — title, date, time, location, the source they come from — and your decision about them.
Purpose: Showing the suggestion, writing it to the calendar or task list after your confirmation, and not suggesting the same appointment twice.
Legal basis: Performance of the contract — Art. 6(1)(b) GDPR. The pseudonymised evaluation of your decisions to improve detection is based on our legitimate interest — Art. 6(1)(f) GDPR. You can object to it (section 7).
The evaluation includes what the card showed when you decided: the suggested appointment, the calendars offered and the overlaps with existing appointments including their title and time. Your account appears in it only as a pseudonym; the message text itself is not included.
Retention: The suggestion until your decision and beyond that, as long as the duplicate check needs it. The evaluation until your account is deleted. Both are deleted completely when your account is deleted.
5.6 Account activity and records
Data: Time and type of the event, the object concerned, the old and the new value, the IP address, and device type and app version as reported by the app. Recorded are: source released or release withdrawn, account connected or disconnected, a provider's access expired, sign-in and sign-out, changes to your settings, and confirmations of the legal documents (5.7).
Purpose: Proving when you agreed to what and when you withdrew it, and being able to answer questions about your account.
Legal basis: Obligation to demonstrate consent — Art. 6(1)(c) in conjunction with Art. 7(1) GDPR. Otherwise, our legitimate interest in traceability — Art. 6(1)(f) GDPR.
Retention: 12 months. Records of a consent or confirmation — releasing a source and withdrawing that release, consent to storing message text, confirmation of the legal documents (5.7) — are kept until your account is deleted, because they prove that processing which is still running is permitted. The IP address is deleted after 30 days in every case. All these entries are deleted when your account is deleted.
These entries are not used for advertising and are not combined into a usage profile.
5.7 Confirmation of the terms of use and privacy policy
Data: Which version of the terms of use you accepted, which version of this privacy policy you acknowledged, and that you confirmed the beta notice — each with time, IP address, device type and app version.
Purpose: Proving that the contract was concluded on these terms and that you received the information; recognising who still has to agree to a new version.
Legal basis: Performance of the contract — Art. 6(1)(b) GDPR; for the record, our legitimate interest — Art. 6(1)(f) GDPR.
Retention: Until your account is deleted. The IP address is deleted after 30 days.
Confirming this privacy policy is not consent to any data processing. We always ask for consents — for example to store message text — separately.
5.8 Voice input
When you dictate in the Capture tab, your iPhone recognises speech on the device. The recording does not leave the device, neither to us nor to Apple; only the recognised text reaches us, as with typed input.
5.9 Account deletion
You can delete your account at any time in the app under Settings → Delete account. MemIQ disconnects all connected accounts — the Telegram session is signed out, Google access is revoked — and deletes your account with all data in this section immediately. With Microsoft, only you can remove the consent; the app shows you where afterwards. Appointments you have already added to your calendar stay there.
6. Recipients
| Recipient | Role | Purpose |
|---|---|---|
| Hetzner Online GmbH, Germany | Processor | Running the website, server and database (3, 5) |
| Mistral AI SAS, France | Processor | Appointment detection (5.4) |
| Threema GmbH, Switzerland | Transmitter | Delivery of Threema messages (5.2) |
| Google, Microsoft, Apple, Telegram, Signal | Providers of your accounts | MemIQ reads and writes there on your behalf (5.2, 5.3) |
We do not sell your data, do not hand it over for advertising, and do not use it to train AI models.
7. Your rights
You have the following rights towards the controller (contact in section 1). We answer requests within one month (Art. 12(3) GDPR).
| Right | Basis | Description |
|---|---|---|
| Access | Art. 15 GDPR | Which data we have stored about you |
| Rectification | Art. 16 GDPR | Correction of inaccurate data |
| Erasure | Art. 17 GDPR | Deletion of your data — you can delete your account yourself in the app at any time (5.9) |
| Restriction | Art. 18 GDPR | Restriction of processing |
| Portability | Art. 20 GDPR | Receiving data in a machine-readable format |
| Objection | Art. 21 GDPR | Against processing based on legitimate interests, e.g. the evaluation in 5.5 |
| Withdrawal | Art. 7(3) GDPR | Withdraw consent at any time with effect for the future |
8. No automated decision-making
MemIQ suggests appointments; you decide whether they go into your calendar. There is no automated decision with legal or similarly significant effect within the meaning of Art. 22 GDPR, and no profiling.
9. Obligation to provide data
To use the app, we need the account data from 5.1, at least one released source and a connected calendar account — without them MemIQ cannot suggest or enter appointments. All consents (releasing individual sources, storing message text) are voluntary; refusing them only restricts the respective feature.
10. Right to lodge a complaint & changes
Right to lodge a complaint (Art. 77 GDPR): You can lodge a complaint with a data protection supervisory authority. The authority responsible for us is the State Commissioner for Data Protection and Freedom of Information of North Rhine-Westphalia (LDI NRW), Kavalleriestraße 2–4, 40213 Düsseldorf, Germany, www.ldi.nrw.de.
Changes to this policy: We update this policy when the processing changes. The version in force is shown on this page with version number and date. For significant changes — such as a new recipient or a new purpose — we will ask you in the app to confirm the new version before you continue to use MemIQ.
